Web Site and Legal Services Package Use

Reasonable efforts will be made to keep Washington eLawyer and its associated Web sites available for use; however, access is not guaranteed to be available all the time. Neither Sharon Blackford PLLC nor Washington eLawyer will be liable for any periodic unavailability of the Web site or associated Web sites.

Washington eLawyer is hosted in two separate locations on two different continents, the United States and Europe. Should circumstances or events outside of our control, for example due to strikes and other industrial disputes, breakdown of systems or network access, fire or explosions, extreme weather events, wars, territorial disputes, political coups, power failure or an Act of God cause one or both of the servers to fail, Washington eLawyer will make every effort to ensure that its website and services are back online as quickly as possible.  Washington eLawyer is not responsible for or liable in any way for any delay in services attributable to such an Act of God.  Nevertheless, if a client is unable to access DirectLaw or Washington eLawyer for such a reason within the seven (7) day service period provided in the Legal Services Agreement, the period during which the client was unable to access Washington eLawyer will be excluded from said seven (7) day limitation.

Due to the nature of the internet and the possibility of third party interference, the Web site is not guaranteed to be free of all viruses and technical defects of any description. We will not be liable for any damage or loss caused by such third party interference as a result of your use of the Web site.

User access to this Web Site is governed by all applicable federal, state and local laws.

The trademarks, logos and service marks displayed on this Web Site are the property of Washington eLawyer or other third parties. Users are not permitted to use these marks without the prior written consent of Washington eLawyer or such third party which may own the Mark. USE OF THE WEBSITE

Washington eLawyer client services are for your personal use only.  You shall not share the client services in any way with any other individual or entity for any reason or purpose.  You shall not permit any other party, whether an individual or entity of any kind, to have access to your username or password, to access your client area on Washington eLawyer's DirectLaw portal, to communicate with Washington eLawyer using your name or email, or to access client services for which you have contracted.  You shall not transfer your Washington eLawyer DirectLaw username or password to any other person or entity for any reason.  Washington eLawyer shall not provide or be obligated to provide any advice, document, consultation or service of any kind to any individual or entity if Washington eLawyer reasonably believes, in its sole discretion, that said entity has obtained access to Washington eLawyer's services in violation of any of the terms of this paragraph, or any of these Terms and Conditions, the Eligibility Check, or the Legal Services Agreement.  If Washington eLawyer reasonably believes you have breached any of the terms of this paragraph, Washington eLawyer can without notice and at its sole discretion revoke your username or password and refuse access to all or any part of the Washington eLawyer and DirectLaw websites.

Use outside the State of Washington of the material, documents, or advice provided by Sharon Blackford PLLC doing business as Washington eLawyer is strictly prohibited.

Cookies

A cookie is a small data file that certain Web sites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you've visited, but the only personal information a cookie can contain is information you supply yourself. Where you have provided information for use in an Eligibility Check, creation of a Legal Services Agreement, and/or client registration on Washington eLawyer's DirectLaw portal, you confirm that the account information you have provided is truthful, complete and accurate. You must keep your account password and information confidential and not share it with any other person. If you lose your password or become aware of access to your account by any person or entity other than you, you agree to notify Washington eLawyer immediately. If you become aware of or should reasonably know about use of your password or account by any person other than you, and if you do not notify Washington eLawyer immediately of such use, you will be responsible for any and all liability incurred by Washington eLawyer or any other user of any Web site associated with Washington eLawyer and/or DirectLaw  due to unauthorized use. If Washington eLawyer believes in its sole discretion that your account has been compromised, Washington eLawyer may require you to update your password. Further, Washington eLawyer may suspend or limit the use of your account, refuse to provide services, and/or place a hold on any transactions. In the event Washington eLawyer reasonably believes in its sole discretion that your actions affect other users or third parties, Washington eLawyer may warn such other users or third parties, including law enforcement. Washington eLawyer may also in its sole discretion investigate any perceived misuse of your account, refer matters to law enforcement, and/or take other legal action.

Access to and use of password protected and/or secure areas of Washington eLawyer and/or the Washington eLawyer DirectLaw portal is restricted to authorized users only. Unauthorized individuals attempting to access these areas of Washington eLawyer and/or the Washington eLawyer DirectLaw portal, or individuals/users attempting to access areas of Washington eLawyer or the Washington eLawyer DirectLaw portal that they do not have rights of access to, will be subject to prosecution to the fullest extent of the laws of the State of Washington and the federal laws of the United States of America.

The Document Preparation Service (the "Document Preparation Service") is designed to collect relevant information and data to assist in the preparation of a legal document on your behalf.

The Document Preparation Service uses a document assembly and drafting system ("the System"). The responses you give will dictate the content of the document produced.

When using the Document Preparation Service you will be asked a series of questions; the answers you give will dictate the content of the document produced by the System. You alone are responsible for ensuring the answers or any information that you give is correct (this includes information in relation to the identity of any parties or signatories, their age or capacity). Sharon Blackford PLLC, doing business as Washington eLawyer relies on you to provide the correct information.  Sharon Blackford PLLC or Washington eLawyer will not check the reliability or correctness of the information you provide.

You must carefully check that the documents produced fully reflects your wishes. If it does not, you should not execute it. It is your responsibility to ensure that any documents are properly executed in accordance with the instructions that are provided to you.

Sharon Blackford PLLC doing business as Washington eLawyer shall not be liable for any failure to provide or delay in providing any service resulting from circumstances or events outside of our control, for example due to strikes and other industrial disputes, breakdown of systems or network access, fire or explosions, extreme weather events, wars, territorial disputes, political coups or power failure.

If any part of these terms and conditions (and/or notices on the Web site) are found to be invalid or unenforceable then such part will be deemed replaced by a valid and enforceable provision that most closely matches the intent or the original part and the remainder of the agreement shall continue in full force and effect.
